EULA - End User License Agreement

BIRNAM LABS ELECTRONIC END USER LICENSE AGREEMENT FOR NETCHIMES VERSION 1.0.

NOTICE TO USER:
THIS IS A CONTRACT. BY INSTALLING THIS SOFTWARE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS END-USER-LICENSING-AGREEMENT (EULA).
By accepting this agreement and continuing with the installation process of this version of the netChimes client and the netChimes server side scripts (The Product), you (The User) are entering into contract with Birnam Labs, LLC (The Company) to legally perform and behave within the following End-User-Licensing-Agreement Terms (EULA).

1. The Product is freely distributable as long as the distribution is not altered an any way from the original format as distributed by The Company. Any copies of The Product that have been altered are in violation of The EULA and Copyright law.

2. The Company is not to be held responsible for any damage, permanent or otherwise, that results from installation, use, misuse, or uninstallation of The Product or any unauthorized distributions of The Product. The Product is distributed AS IS and can not be blamed for unwanted results. These results include and are not limited by results on The User's client computer and from results from the scripts on the server.

3. The Company is not responsible for any violation of hosting agreements made by The User with their web host. The Company is not responsible for agreement violations including, but not limited to, unauthorized opening of a network socket, use of unauthorized network port, unbalanced processor usage, and unbalanced bandwidth usage.

4. The Company is not to be held responsible for The Product acting in a manner other than as advertised. Any undesired behavior from The Product must be accepted AS IS.

5. The Company is not responsible for unauthorized variations of The Product in any way.
